A bailiff gets control 8

The moment when it all went wrong

Until Peter opened the door, Mr Green had no rights or powers of any sort.
If he had ignored the bailiff, there's nothing Mr Green could have done, he have kicked the door, banged on the glass, shouted, or even danced an Irish Jig for all the good it would have done legally.
Green relied on Peter’s ignorance and good manners.

The Threshold Maneuver  (short explanation)

Many bailiffs consider this to be a lawful way of gaining peaceful entry.
The trick is to have their foot resting on the door before you open it, and their body weight does the rest.
Once their foot is across the threshold, many bailiffs say they have achieved Peaceful Entry, and have the right to force entry.
But it isn’t legal, because Peaceful Entry cannot be gained without the consent of the householder, unless it's been achieved by the Alice in Wonderland interpretation of “invitation” by leaving a door or window open so that they can climb or walk through. Some bailiffs push their way into the house at this point, adding assault to the original offence of trespass.

The problem is; once they're inside, how does the householder prove that a crime has been committed? And whose word will the police accept?  Invariably the answer is;...the word of the bailiff.
So the first rule when a bailiff calls is: NEVER EVER OPEN THE DOOR <<<<< Last page <<<<<----------------------->>>>> Next page >>>>>
